The General Conditions of Contract regulate the distance selling relationship between Navartina SL. and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of April 13, on General Contracting Conditions, Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users, Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, of Information Society Services and Electronic Commerce. 

Navartina SL reserves the right to make any changes it deems appropriate, without notice, in the General Conditions. Such modifications may be made through their websites, by any means admissible in law and shall be binding during the time they are published on the web and until they are not validly modified by subsequent ones. However, Navartina SL reserves the right to apply, in certain cases, Special Conditions of Contract in preference to these General Conditions when it deems appropriate, announcing them in a timely manner. 

The purpose of the website is to offer and advertise services and musical instruments. The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal. 

As a user or customer, you expressly declare to know, understand and accept the conditions of use and these general conditions of contract. Likewise, you declare to be of legal age and have the legal capacity and ability to act necessary to access the websites of Navartina SL and contracting through these. 

To purchase our products, you can go to the appropriate section of our online store.  

It is a prerequisite that you register as a user of the web to make the purchase online. You can access the corresponding section for registration on the website itself. In accordance with the provisions of Law 15/1999 on Protection of Personal Data, Navartina SL informs users that personal data collected during the registration process and subsequent purchase, will be entered into a file under its responsibility, in order to process such actions by the user and manage subsequent actions arising therefrom. Until you inform us otherwise, we understand that your data have not been modified, that you agree to notify us of any changes and that we have the consent to use them in order to build loyalty in the relationship between the parties. 

During the purchase process you must identify yourself with the user name and password provided. These data will not be public. You are responsible for treating confidentially and responsibly the identity and password obtained in the registration as a customer, not being able to transfer them to another. You can modify the registered information at any time, in your customer area. In this same section you will have access to a history of your orders, this is only a consultation section, but its management is allowed, and the user can delete those records that he considers it is not necessary to view. 

Once the purchase process is finished, the customer will receive a confirmation of the order by e-mail. It is essential that during the purchase process the user indicates a valid email address. Offer and validity 

In case of a product on offer, it will always be indicated next to its essential characteristics, the offer price and the validity of the same. 

In compliance with current regulations Navartina SL provides information on all items on sale, their features and prices. However, Navartina SL reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of the same. Thus, the products offered at all times by the web will be governed by the General Conditions of Contract in force in each case. Likewise, the company shall have the right to stop offering, without prior notice and at any time, access to the aforementioned products. 

Essential characteristics of the products 

The products offered in our online store incorporate a photograph and the essential characteristics of the same, this is the information obtained from the manufacturer itself and due to the light conditions when taking the photographs there may be changes of tone in them. 

Warranties 

All products offered on the website enjoy the relevant commercial guarantee. Navartina SL has an after-sales service, while the warranty is in force, the customer may execute it by contacting the establishment of Navartina SL, the after-sales service, by email to info@sax-on.com or the points established by the supplier itself. The warranty period is the one indicated by law at the time of purchase of the product.

Prices 

All products indicate the selling price in Euros and include Value Added Tax (VAT) when the customer is within the European Economic Community. If this is not the case, or if the customer is located in Ceuta, Melilla, Canary Islands or Andorra, the prices are shown as export prices, taxes not included.

If any other tax is applicable, this will be indicated. 

Delivery and transport costs 

Navartina SL only makes shipments worldwide charging an amount depending on the weight and size of the products ordered for shipping and handling. 

The transport times once all the ordered products are available in our warehouse are indicated in the process of finalizing the purchase, and the customer can select the one that suits him best.

Shipments are made by an external company, in no case shall be entitled to claim any compensation for delays in deliveries.

Methods of payment and execution of the order 

The client will be able to pay the amount of his order opting for any of the following forms. During the purchase process you must indicate your choice: 

VISA or MASTERCARD 

All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on the standard security technology SSL

(Secure Sockets Layer). All the information you transmit to us travels encrypted through the network.

Likewise, your credit card information is entered directly on the bank's website, at the POS (Point of Sale Terminal of the Bank) and is not entered or recorded on any server Navartina SL.

When paying with VISA or MASTERCARD you will always be asked for the following information: the card number, the expiration date, and a Validation Code that matches the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction. 

When the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, the cardholder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and recredit entries in the accounts of the supplier and the cardholder shall be made as soon as possible. 

However, if the purchase had actually been made by the cardholder and the demand for refund was not the result of having exercised the right of withdrawal or termination and, therefore, had improperly demanded the cancellation of the corresponding charge, he will be obliged to Navartina SL to compensate for damages caused as a result of such cancellation. 

Bank Transfer 

When you select the bank transfer you will receive, together with the confirmation of your order, an e-mail with the bank details of Navartina SL.

It is very important that when making the transfer you indicate in the subject the order number, as well as your name and surname, and make the transfer no later than 24h from the date of order confirmation in order to validate it, otherwise the order may be canceled at our discretion. 

Documentation:  It is essential to send us the proof of the transfer by e-mail to info@sax-on.com . But, in any case, the order will not be considered effective until our administration department does not have bank confirmation of the transfer. 

We remind you that the payment must be made in EUROS and that all possible exchange and bank fees are your responsibility. 

In the case of bank transfers made from outside Spain, it is very important that when ordering the transfer, you always inform your bank to take charge of the commissions in origin, those bank commissions and expenses corresponding to your bank. Otherwise, Navartina SL could paralyze the shipment of your order if we do not receive the full amount of it. 

Possible exchange and bank commissions are borne by the customer. 

Bizum

You can make the payment by bizum using the payment gateway of the bank and the pin provided by your bank, in payments to the company does not use the phone number of the company.

Delivery of the products

Navartina SL will deliver the order within the period indicated at the time of purchase except for force majeure or delays in delivery by manufacturers / distributors.

The availability of products offered by Navartina SL may vary depending on customer demand. Although Navartina SL updates the stock in real time, the product requested by the customer may be out of stock at that time. In case of non-execution due to unavailability, Navartina SL at the time it becomes aware of this situation will notify the customer by email. 

Right of withdrawal, returns and complaints 

The buyer will have a maximum period of fourteen calendar days to withdraw, from the day the customer receives the product, without penalty and without indicating the reasons. 

The exercise of the right of withdrawal must be made by notification via email info@sax-on.com or by sending your letter to our postal address CALLE PEREZ GALDOS 42, 08012, BARCELONA. 

According to the provisions of Article 103 of Law 3/2014 of 27 March, which amends the revised text of the General Law for the Defense of Consumers and Users, those of the consumer or clearly personalized, or that, by their nature, can not be returned or may deteriorate or expire rapidly, are exempt from withdrawal. 

Excluded from the right of withdrawal are all second-hand products sold on this website (vintage/used category), as long as they do not present any damage contemplated in the descriptive photos of the product and/or previously agreed with the customer.

The return 

The customer must return or deliver the product directly to Sax & Clarinet ON, to the address CALLE PEREZ GALDOS 42, 08012, BARCELONA, without undue delay, and in any case within a maximum period of 14 (fourteen) calendar days from the date on which the right of withdrawal of the contract is formalized. It will be understood that the deadline has been met if the customer returns the product before the end of the period. 

The return postage is borne by the customer, and may use any transport agency that delivers to our store, in any case we will not accept pickups at the post office or points other than our store.  Navartina SL can manage the return of the product with a minimum shipping and handling charge of 10 € taxes included depending on the weight and volume of the shipment.

In any case, the products to be returned must be in perfect condition, unused and since most of the products we sell are collectible products, the packaging is considered an accessory to the product and must be in perfect condition as it arrived. Therefore, please make sure that the package is properly protected and sealed to avoid any problems during transport. Once received, we will check its condition. As soon as we verify that the item/s, as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to refund the money paid. 

Refund of payment 

The refund of the amounts received will be made using the same means of payment used by the customer and in the shortest possible time since the product has arrived at the facilities of Navartina SL.

Return of defective product

In the event that the product is not in good condition and the causes attributable to this, not the result of the customer, the customer shall be entitled to return the product, informing Navartina SL the reason for return through any of the means provided in these conditions of contracting, and at no cost to the customer. This return due to defect or poor condition of the product will not be considered a right of withdrawal. 

Navartina SL undertakes to bear the cost of the return and to return the product for a new one in accordance with the conditions accepted at the time of sale.

In no case will be accepted carriage forward or unauthorized returns. 

Jurisdiction 

Also, Navartina SL reserves the right to file civil or criminal actions it deems appropriate for the misuse of its website and content or for breach of these conditions. 

The terms and conditions governing this Web Page and all relationships that may arise are safeguarded by the Spanish legislation in force. The parties submit to the jurisdiction of the courts and tribunals of the city of the CLIENT, unless the law imposes a different jurisdiction.
